1. About the Art Competition
The Babalakin & Co. Art Competition (the “Competition”) is organised by Babalakin & Co. Legal Practitioners (the “Organiser”) for the purpose of fostering artistic creativity, promoting emerging artistic talent, and supporting the development and visibility of contemporary artistic expression.
The Competition provides eligible participants with an opportunity to submit original artworks for review, evaluation, and potential selection by an independent art curator.
2. Organiser
The Art Competition (“Competition”) is organized by Babalakin & Co, a law firm duly registered in Nigeria (“Organiser”).
3. Acceptance of Terms
By accessing this website, registering, submitting an entry, or participating in any aspect of the Competition, each participant (“Artist” or “Participant”) agrees to be bound by these Terms and Conditions (“Terms”).
The Participant further accepts that these Terms may be altered, amended, varied or otherwise modified by the Organiser at any time up to and including the final determination of the Competition and at all times these Terms are at the sole discretion of the Organiser.
4. Eligibility
The Competition is strictly open to young artists aged between 18 and 30 years, as at the submission closing date.
Participants may be required to provide proof of age and identity to confirm eligibility. The Organiser reserves the right to disqualify any Participant who does not meet the eligibility requirements or who provides inaccurate, misleading, or incomplete information.
5. Eligible Artworks
Eligible artworks for this competition include:
- paintings,
- sculptures,
- drawings
6. Age Verification
All Participants are required to upload a valid government-issued identification document (such as a national ID card, passport, or driver’s licence) during registration for age verification purposes only.
The Organiser reserves the right to:
- verify the authenticity of submitted documents; and
- disqualify any Participant who provides false, misleading, altered, or incomplete age verification documents.
7. Competition Structure and Stages
Stage One – Submission and Shortlisting
During the initial submission phase, Participants must submit a photograph or digital image of a completed artwork, together with any required supporting information, in accordance with the instructions provided by the Organiser.
All eligible submissions will be assessed based on evaluation criteria determined by the Organiser, which may include artistic merit, originality, technical execution, and conceptual relevance. Following this assessment, a selection of artworks will be shortlisted.
Stage Two – Physical Submission and Exhibition Selection
Shortlisted Participants will be contacted and invited to submit their physical artworks to the appointed art curator for further review and curation.
From the shortlisted artworks, a final selection will be made for inclusion in a curated exhibition. Only artworks selected at this stage will be exhibited.
The shortlisted artists, exhibited artworks, and winning artworks shall be based on the evaluation criteria applied by the Organiser and/or the appointed curator.
All decisions are final and binding, and no correspondence will be entered into in relation to the selection outcomes.
8. Submission Requirements
Registration and artwork submission must be completed through this website https://art-competition.babalakinandco.com/.
Each Participant must:
- complete the registration form accurately; and
- upload their artwork in accordance with the specifications and any required supporting materials within the submission period stated on the website.
Late submissions, incomplete entries, or entries submitted outside the official platform will not be accepted.
Unless otherwise stated, each Participant may submit a maximum of 3 (three) artwork(s).
9. Artwork Requirements
All submitted artworks must be original works created by the Participant and must not infringe the intellectual property rights or other rights of any third party.
By submitting an artwork, the Participant represents and warrants that:
- the artwork is their own original creation;
- they hold all necessary rights to submit the artwork; and
- the submission and any subsequent use of the artwork by the Organiser in accordance with these Terms does not violate any applicable laws or third-party rights.
The Organiser reserves the right to reject or remove any submission that, in its sole discretion, violates these Terms.
10. Selection and Shortlisting
Submitted artworks will be reviewed and evaluated based on criteria determined by the Organiser, which may include artistic merit, originality, and relevance to the Competition’s objectives.
At the end of the submission period, eligible artworks will be reviewed and shortlisted by a panel of judges appointed by the Organiser.
The evaluation criteria may include (but are not limited to):
- originality;
- creativity;
- artistic technique;
- conceptual strength; and
- overall impact.
The decisions of the judges and the Organiser are final and binding, and no correspondence or appeal regarding selected outcomes will be entered into.
All submissions will be evaluated anonymously to guarantee fairness and eliminate any biases.
Successful artworks may be shared with a third-party art curator for the purposes of evaluation, curation, and selection to proceed to the next round of the competition
11. Exhibition of Artworks
Successful Participants (including shortlisted participants, as applicable) will be notified using the contact details provided at the time of application.
Successful Participants may:
- have their artworks exhibited, published, or otherwise featured in connection with the Competition; and/or
- be invited to participate in related events, exhibitions, or promotional activities associated with the Competition.
Any additional terms applicable to successful Participants, including exhibition conditions or prizes (if any), will be communicated separately.
All selected Artists will be contacted and provided with full delivery details and the delivery of the artworks to and from the exhibition shall be the responsibility of the Artists.
The shortlisted artworks will be physically displayed at the Organiser’s premises at the Exhibition Finale and Awards Event (“Exhibition Event”).
By participating, the Artist agrees to make their artwork available for display at:
- the Exhibition Event; and
- a subsequent exhibition curated by the Organiser’s designated curator for a period of three (3) months following the event.
After the exhibition period, the artworks will be returned to the respective Artists, subject to reasonable collection arrangements and timelines communicated by the Organiser or curator.
12. Awards and Winners
The winners will be announced at the Exhibition Event and shall include:
- 1st Place
- 2nd Place
- 3rd Place
- 4th Place (People’s Choice Award)
13. Intellectual Property Rights
The Organiser acknowledges that all copyright and intellectual property rights in works created by the Artist shall remain vested in the Artist.
Notwithstanding this, as a condition of entry into the Competition, the Artist hereby grants, and agrees to grant, to the Organiser all necessary rights, licences, consents, and authorisations to record, photograph, film, reproduce, display, and otherwise include the artwork in any footage, images, or materials captured or created in connection with the Competition and/or exhibition.
This shall include, without limitation, the right to use such materials for the purposes of promoting the Competition, publicly exhibiting the work, and referencing or displaying the artwork across digital platforms and media operated or controlled by the Organiser.
For the avoidance of doubt, the Artist grants the Organiser a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, and communicate such footage and materials, including in electronic and digital formats, solely for purposes connected with the Competition. Where any additional consent from the Artist is required to give effect to this clause, such consent shall not be unreasonably withheld in connection with the Competition and exhibitions.
No additional compensation shall be payable for such use beyond any prizes awarded.
14. Care of Artworks
The Organiser and appointed curator shall take reasonable care of the artworks while in their custody.
However, to the fullest extent permitted by law, the Organiser shall not be liable for:
- minor wear and tear;
- damage resulting from inherent material defects; or
- events beyond reasonable control
15. Use of Personal Data
Personal data collected in connection with the Competition will be processed in accordance with the Organiser’s Privacy Notice [BC Art Competition Privacy Notice 2026]
By completing the entry form, the Participant agrees to the processing of their personal data by the Organiser for the purposes and in the manner described in the privacy notice.
The Organiser acknowledges that the Artist’s personal information will not be shared with third parties or otherwise processed for alternative purposes without the Artist’s consent.
16. Disqualification and Withdrawal
The Organiser reserves the right to disqualify any Participant who:
- breaches these Terms;
- provides false information;
- engages in fraudulent, dishonest, or unethical conduct;
- acts in a manner inconsistent with the objectives or integrity of the Competition; or
- acts in a manner that brings the Competition or Organiser into disrepute.
17. Warranty
By registering for this Competition, and by providing any further information to the Organiser in relation to the Competition, the Artist warrants that all such information supplied is truthful, accurate, and not misleading or otherwise incomplete.
The Artist hereby warrants that they own the copyright to the artworks and further warrant that the work contains no feature or aspect or material that constitutes a breach (or potential/anticipatory breach) of a third party’s intellectual property.
Where it reasonably or justifiably appears to the Organiser, that the Artist is in breach of these warranty, or where the Organiser understands or apprehends there to be a risk that the Artist, has or will bring the Competition or the Organiser into disrepute, the Organiser shall be entitled to take such steps as are necessary to conclude the Artist’s involvement in the Competition forthwith.
18. Limitation of Liability
To the fullest extent permitted by law, the Organiser shall not be liable for any loss, damage, or destruction of an artwork submitted for exhibition, including but not limited to loss of profits or any indirect, incidental, or consequential losses, except where such loss or damage results directly from the Organiser’s negligence.
In any event, the Organiser’s total liability arising from or in connection with these conditions of entry, whether in contract, tort, negligence, or otherwise, shall be limited to the lesser of:
- the value of the artwork as declared on the Entry Form (where provided); or
- the value determined by an independent valuer appointed by the Organiser.
19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from the Competition shall be subject to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria.
20. General Terms
The Organiser’s decisions in relation to all matters concerning the Competition shall be final and binding. The Organiser reserves the right, at any time and without prior notice, to amend, vary, modify, suspend, or discontinue the Competition or these Terms.
The Artist acknowledges that, in entering into these Terms, they do not rely on and shall have no remedy in respect of any statement, representation, assurance, or warranty not expressly set out herein, whether made innocently or negligently.
These Terms and Conditions, as amended from time to time, constitute the entire agreement between the parties and supersede all prior or contemporaneous agreements, understandings, representations, or arrangements, whether written or oral, relating to their subject matter.
The Artist shall indemnify and hold harmless the Organiser from and against all liabilities, losses, damages, costs, and expenses (including legal and professional fees on a full indemnity basis) arising out of or in connection with any breach of these Terms by the Artist.
